If nations do not introduce new types of legal performance and enforcement mechanisms that work on AI systems any move to hybrid human/AI teams will be fraught with material new legal and commercial risks. Humans with limited span of control cannot be meaningfully responsible for AI. AI span of control is exponentially larger than a human's span of control. A military general cannot meaningfully control a drone swarm with an analogue legal policy or chain of command. How do we fix the AI span of control problem? Techno-legal solutions like smart legal contracts and legally authenticated data are a key part of the solution to mitigate AI lawlessness.
